TRUSTEE ELECTIONS BYLAW
Board of Education of School District No. 37 (Delta)
A bylaw to provide for the determination of various procedures for the conduct of general school
trustee elections
WHEREAS the School Act provides for the Board of Education of School District No. 37 (Delta)
to determine, by bylaw, various procedures for the conduct of general school trustee elections;
AND WHEREAS the Board of Education of School District No. 37 (Delta) wishes to establish
various voting procedures and requirements under that authority;
NOW THEREFORE the Board of Education of School District No. 37 (Delta), in an open
meeting of the board, enacts as follows:
Citation
This Bylaw may be cited for all purposes as “School District No. 37 (Delta) Trustee Elections
Bylaw No. 1”
Definitions
All terms used in this bylaw shall have the meanings assigned by the School Act, the Local
Government Act, and the Local Elections Campaign Financing Act, except as the context
indicates otherwise.
“Board” means the Board of Education of School District No. 37 (Delta).
“By-election” means a trustee election to fill a vacancy on the Board in any of the circumstances
described in section 36 of the School Act.
“Election” means a trustee election, including general school elections and by-elections.
“General Voting Day” means the date on which general voting for a trustee election is to take
place, whether part of a general school election or a by-election.
“Minister” means the Minister of Education and Child Care.
Part 1
1. Application
This bylaw applies to both general elections and by-elections, except as otherwise
noted.
Part 2
2. Application of Local Government Bylaws
If the City of Delta conducts all or part of an Election, the election bylaws of the City of
Delta, as they may be amended from time to time, apply to that trustee election or part of
the trustee election, except for bylaws determining the minimum number of nominators,
the order of names on the ballot, the resolution of tie votes after judicial recount,
requiring a nomination deposit, or any other matter on which the local government
bylaws may not by law apply to a trustee election.

3. Voters List
The most current available Provincial list of voters prepared under the Election Act is the
register of resident electors 52 days before general voting day for each election.
4. Advance Voting Opportunities
4.1 Unless the Board is exempted from the requirement by Order of the Minister, an advance
voting opportunity will be held on the tenth day before general voting day.
4.2 Unless the Board is exempted from the requirement for an additional advance voting
opportunity by Order of the Minister, if the City of Delta conducts all or part of a trustee
election on the Board’s behalf, an additional advance voting opportunity will be held for
that trustee election or part of that trustee election being conducted by City of Delta on the
Board’s behalf, on the date specified in the by-laws of the City of Delta.
4.3 Unless the Board the Board is exempted from the requirement for an additional advance
voting opportunity by Order of the Minister, where the Board is conducting all or part of a
trustee election, an additional advance voting opportunity for that trustee election or part of
a trustee election will be held 3 days prior to general voting day.
5. Nomination of Candidates
A candidate for the office of school trustee must be nominated by at least two qualified
electors of School District No. 37 (Delta), in accordance with the Local Government Act.
6. Order of Names on the Ballot
The order of names of candidates on the ballot will be alphabetical in accordance with
the School Act and the Local Government Act.
7. Resolution of Tie Vote after Judicial Recount
In the event of a tie vote after a judicial recount, the tie vote will be resolved by lot in
accordance with the School Act and the Local Government Act.
8. Nomination Deposit
A nomination deposit is not required for nomination for the office of school trustee.
9. Public Access to Election Documents
9.1 The Board authorizes public access to nomination documents of the trustee
candidates:
9.1.1 during the regular office hours at the Board’s office from the time the
nomination documents are delivered until 30 days after declaration of the
election results; and
9.1.2 by internet or other electronic means during the regular office hours at the
Board’s head office, except that public access by the means set out in
this sub-paragraph may not include the residential address of the person
nominated, other than the municipality, electoral area or treaty lands in
which the person is resident.
9.2 The Board will make available to the public by internet access, without charge,
during the regular office hours of the Board’s head office, the disclosure
statements or supplementary reports required to be made available by the BC
chief electoral officer on an Elections BC authorized website, other than
9.2.1 a mailing address or residential address of a significant contributor, or
9.2.2 a telephone number, mailing address, or residential address of a
candidate.
until 5 years after general voting day for the election to which the trustee’s
disclosure statements and supplementary reports relate by providing a copy of
that information for inspection.
10. Public Notice Posting Places
For the purpose of trustee elections conducted by the Board, the following are
designated as public notice posting places for the purposes of section 50 of the Local
Government Act:
10.1 the notice board located at the main entrance to the Board’s head office; and
10.2 the notice board located at the main entrance to Delta City Hall.
11. Publication by Means Other Than Newspaper
The Board designates the following means of publication of notices required to be
published pursuant to section 94.2 of the Community Charter:
11.1 the School District website at deltasd.bc.ca; and
11.2 official School District social media accounts (on Facebook@deltaschooldistrict;
and on Instagram@deltasd37).
12. Repeal
School District No. 37 (Delta) Trustee Elections Bylaw No. 1, dated June 7, 2022, is
repealed.
